Amphora Terms & Conditions (2021)

General

This web document (2021) supersedes all previous Amphora Terms & Conditions documents with immediate effect and, until superseded by any new Terms & Conditions, constitutes the only terms on which we, as the Seller, are prepared to contract with the Buyer.

Prices

All prices quoted are exclusive of VAT, unless specifically stated otherwise.

Payment

Payment is due on receipt of an invoice unless Account Credit facilities have been arranged in advance.  For Account Credit terms payment is due on or before the fifteenth day of the calendar month following the month in which the goods are invoiced.  For payments not made by the due date, the company is entitled to charge and receive interest on the unpaid balance at the rate of 4% above clearing bank base rate for the time being from invoice date to actual payment.

Risk and Title

Risk of damage or loss of goods shall pass to the Buyer upon delivery.  Goods remain the property of the Seller until the Buyer has made payment in cash or cleared funds of the full purchase price, together with any other sums due to the Seller.  The Seller may repossess and dispose of any goods in which it has property and the Buyer grants all rights required by the Seller to locate, to gain access, to mark and remove them.  Until property in the goods passes to the Buyer, the Buyer shall hold the goods as the Seller’s fiduciary agent and bailee.

Limitation of Liability

Save in the case of our negligence, we shall not be held liable for any death nor personal injury arising from the sale of wine to you.  In all cases, including any negligence or breach of contract by us, we shall not be liable for any financial or consequential loss of any nature and the limit of our liability shall be the purchase price of any wines found to be defective, or otherwise not in accordance with the terms of this contract.

Storage

To avoid wine becoming oxidised it is important to ensure the cork is kept moist and therefore bottles should always be kept horizontally.  Temperature is the most important factor in helping to keep wine in perfect condition. The ideal storage temperature is 52F.  It is important to avoid big changes in temperature, so try to maintain a constant temperature throughout the year.
